Impacts on the Town Tree Canopy
All trees and shrubs planted on the public right-of-way are the property of the Town. The Director of Parks and Recreation has exclusive jurisdiction and supervision over all trees and shrubs planted and growing on Town property. Municipal Code Section 8.7 – Trees and Shrubs [PDF] contains provisions regarding the preservation and protection of all Town-owned trees and shrubs.
A Tree Impact Permit [PDF] must be obtained by residents and/or contractors prior to performing any activity that will impact the community’s tree canopy. These activities include:
- Planting of a tree or shrub on Town-owned property
- Trimming branches larger than one inch in diameter on a tree rooted on Town-owned property
- Removing a tree or shrub on Town-owned property (including dead trees)
- Excavating or digging inside the drip line of a Town-owned tree
Planting a Tree or Shrub on Town-Owned Property
A tree or shrub cannot be planted on the public right-of-way without written permission from the Director of Parks and Recreation. A Tree Impact Permit is required to be submitted and approved before a tree or shrub can be planted. All permit applications shall be reviewed by Town staff to avoid any potential conflicts with existing utilities, pedestrian accessibility, and vehicular traffic zones. An approval will be issued if the proposed planting is suitable as to species and location. Once any tree or shrub is planted in the public right-of-way, it becomes the property of the Town. Any tree or shrub planted in the public right-of-way is subject to removal by the Town unless a permit for such planting has been obtained.

Trimming Branches Larger than One Inch in Diameter OR Removing a Tree or Shrub on Town Property
(including Dead Trees)
Any tree or shrub located on, or growing in, the public right-of-way or other Town-owned property cannot be pruned or removed without the written permission from the Director of Parks and Recreation. A Tree Impact Permit must be obtained before the tree or shrub can be pruned or removed. The pruning practice of topping is prohibited on any Town-owned tree.
Excavating or Digging inside the Drip Line of a Town-Owned Tree
In order to protect the roots and health of Town-owned trees, a trench or any other hole deeper than one inch cannot be dug on Town property within an area closer than one foot of the outer dripline of any tree without the permission of the Director of Parks and Recreation. A Tree Impact Permit must be obtained prior to the beginning of any work, unless otherwise specifically provided in a franchise agreement.
